What Were You Thinking?! Unconscious Assumptions and Biases in Mediation

This in-person educational event will examine underlying assumptions and biases in mediation which often go unexamined.

For example:

● Settlement negotiations should focus on objective criteria and outcome predictions;
● Participants are rational actors;
● Mediators should attempt to persuade in the same way regardless of a person’s background;
● It is not the job of the mediator to call out prejudice or bias in the mediation.

Experienced mediators and experienced users of mediation will discuss their perpectives on these and many other unconscious and unaddressed assumptions that are often present in any dispute resolution process.
